Scott Mills advises management and employer clients to develop strategic solutions to their employment and labor law compliance needs.  For more than twenty-five years, Scott has worked with government contractors, financial service firms, accountants, enrolled agents, law firms, medical and dental practices, building trade professionals, trade associations, housing, community and property owners’ associations, multi-family housing providers, and NGO’s to evaluate, plan, counsel, organize, and implement effective, strategic employment and labor law compliance solutions.  He regularly counsels and advises corporate boards of directors, executives, human resources professionals, and senior managers to ensure legal compliance regarding recruitment, documentation of disciplinary and grievance procedures, terminations, and post-termination dispute resolution.

 

Scott’s areas of concentration include:

 

  • Workplace policies and procedures, Ethics and Business Conduct policies, and employee handbooks

  • Federal contractor compliance under the Service Contract Act, Federal Acquisition Regulations, the Fair Labor Standards Act, Presidential Executive Orders, the False Claims Act, NISPOM, and regulations promulgated by the U.S. Department of Labor, the Office of Federal Compliance Programs, and the Equal Employment Opportunity Commission

  • Equal employment opportunity and compliance with all state and federal employment human rights laws

  • Negotiating and enforcement of restrictive covenants, noncompete and nonsolicitation agreements, and trade secret and intellectual property protections

  • Employment agreements, executive compensation plans, and bonus and incentive plans

  • Labor negotiation of collective bargaining agreements as well as litigation of labor disputes and bargaining unit certifications before the National Labor Relations Board

  • Independent contractor and consulting agreements

  • Representation before administrative agencies in compliance audits and investigations

  • Civil litigation and appellate advocacy of employment and labor law matters

 

Scott effectively represents management clients before local human rights commissions, the U.S. Equal Employment Opportunity Commission, the U.S. Office of Federal Contract Compliance Programs, the U.S. Department of Labor, the D.C. Department of Employment Services, the Virginia Department of Labor and Industry, the Virginia Employment Commission, the National Labor Relations Board, and other federal and state agencies.

 

Scott investigates internal complaints of discrimination on behalf of management and provides advice regarding appropriate responses for abatement in compliance with state and federal law. Scott also performs employment and labor law compliance audits for employers in both private and public contracting sectors. His employment and labor law compliance audit services also assist in the completion of due diligence for business entity sales and transactions.

 

Scott has designed and facilitated more than 100 workplace and professional training and CPE/CLE accredited educational programs. He designs compliance training for clients and local and national trade and professional associations. His facilitation style engages boards of directors, officers, managers, and employees toward a better understanding of and compliance with workplace policies and procedures.

 

Scott also represents management and business owners in litigation, arbitration, and mediation of workplace disputes. He has substantial appellate advocacy and administrative claims experience at both the state and federal levels.

 

Scott is admitted to practice law before state and federal courts and administrative agencies in the Commonwealth of Virginia and the District of Columbia.
